Whether Hon'ble High Court at Delhi has jurisdiction to entertain the Petition seeking rectification of a Trade Mark bearing Trade Mark Application No.3897902 registered by Trade Mark Registry, Mumbai, in favour of the Respondent having his registered address in the State of Madhya Pradesh? Ans: If the aforesaid interpretation of Khajoor Singh (Supra) and Kusum Ingots and Alloys Ltd (Supra) are correct and considered as applicable to the term 'The High Court' and its power then, it can be stated that the respective 'High Court' having jurisdiction over the respective Trade Mark Registry is the appropriate 'High Court' within the meaning of Section 57 of the Trade Marks Act, 1999 as amended by Tribunal Reforms Act, 2021. The cause of action and effect of registration over the 'Person Aggrieved' beyond the territorial limits of the 'High Court' are not the relevant considerations u/s. 57 of the Trade Marks Act, 1999.
