Mr. Deshpande, learned counsel submitted that in the matter of grant of bail to the accused charged for the offence under the Act it is exclusively controlled by the provisions contained under Section 37 of the Act. In that the power of the High Court under section 439 of Criminal Procedure Code to grant bail is also subject to the limitations placed under Section 37 of the Act. He placed reliance on the decision of the Apex Court in Narcotics Control Bureau, Appellant v. Kishan Lal and others, - Respondents . The Apex Court observed as under:
