In the light of the said conclusion reached by me on facts, I am of the view that the decision of the Bombay High Court in the case of Smt. Krishnabai and Others v Baburao and Others and of the Allahabad High Court in the case of Udrej Singh and Another v Ram Bahal Singh and Others , relied upon by Sri Srinivasan, are of no assistance to him.
