20. Thus, in view of this Court, the learned
Court below has wrongly convicted the appellants
merely on the basis of the statement made before the
Court. The learned trial Court has placed reliance on
the judgment of Hon'ble Apex Court in the matter of
State of Uttar Pradesh Vs. Chhotelal reported in (2011)

2 SCC 550 & Pushkar Singh Vs. State of Uttarakhand
reported in (2012) 78 A.C.R. 703. The ratio of both the
judgments is not applicable in the present case. No
reasons have been recorded by the learned Court below
in convicting the appellant.
