4. Apex Court in P. Sarathy v. State Bank of India it was held that for application of Section 5 of the Limitation Act, Court need not be a civil Court, but, it will be sufficient if the authority or tribunal has trappings of Court. Apex Court has considered the question regarding application of Section 14 of the Limitation Act in a proceeding before the Deputy Commissioner of Labour who is notified as appellate authority under the Shops and Establishments Act. It was held that time spent before Shop Appellate Authority can be excluded for computing the period of limitation in view of Section 14 of the Limitation Act.
