In Parmanand Katara v. Union of India reported in AIR 1989 SC 2039 and subsequently in Paschim Banga Khet Mazdoor Samiti v. State of West Bengal reported in AIR 1996 SC 246 the Hon'ble Supreme Court has re-emphasised the Governmental obligation to provide medical facilities. In these judgements, the Hon'ble Supreme Court has created a justiciable right to health. Thus, in the present scenario, in the Indian context, Right to Health falls within the ambit of Right to Life as guaranteed under Article 21 of the Constitution of India.
