22. The learned Single Judge (R.K. Deshpande, J,) considered the
ratio of judgment of the Apex Court in Dhruv Green Field Ltd. vs.
Hukam Singh & Ors.6 dealing with the issue of bar of jurisdiction of
Civil Court and held that if there is express provision in statute barring
jurisdiction of Civil Court to deal with the matters specified thereunder,
jurisdiction of ordinary Civil Court shall stand excluded. This Court
further held that even in cases where jurisdiction of Civil Courts is
barred, expressly or impliedly, the Court would nonetheless retain its

jurisdiction to entertain and adjudicate the suit provided the order
complained of is a nullity.
