Gandhi2, K.Satwant Singh v. State of Punjab3 and Maya Rani
Punj v. CIT4, the Apex Court observed that confiscation being not a
punishment does not come in either of the categories. Thus viewed, the
property of an accused facing trial under the 1988 Act could be attached
and there can be administration by a third party of the said property and
eventual forfeiture after conviction.
