Charge Sheet, only by taking into account the
sworn affidavit of the 2nd respondent has issued
summons which is contrary to the observations
made by the Hon'ble High Court for the combined
State of Andhra Pradesh in case between S.Bala
Krishna v. The State of Telangana and others1
and also the observations made by the Hon'ble
Apex Court in case between Minu Kumari and
others v. The State of Bihar and Others2.
