In support of that contention, reliance was placed on the decision of the Supreme Court in State of U. P. v. Mohammad Nooh, (1958) SCA 73 : (AIR 1958 SC 86) (F). In that case, a Government servant had been dismissed in 1948 and the Supreme Court held that he could not obtain any relief by an application under Article 226, although an appeal from the order of dismissal and a subsequent application for revision had been disposed of after the Constitution had come into force.
