The similar issue arose before Delhi High Court and in light of the judgement of Arif Khan (supra), learned single Judge referred the matter to larger bench and Division Bench of the High Court of Delhi in case of Nabi Alam Vs. State (Govt. of NCT of Delhi) MANU/DE/1045/2021 after analyzing the judgement of Vijaysinh Chandubha Jadeja (supra) and Baldev Singh (supra) observed as under:
