A.V. D'Costa vs B. C. Patel And Another on 4 March, 1955
In this behalf, I am bound by the decision of the Division Bench of this Court in A. v. B, reported in 80 Bombay LR 384, referred to above, Similarly, in view of the decision of this Court in Smt. Gangu Pundlik Waghmare v. Pundlik Maroti Waghmare , it would not be permissible for me to refuse to award maintenance pendente lite and the expenses of the proceedings to the wife merely because there are wild and baseless allegations made by the husband against the wife. In saying so. I cannot lose sight of the fact that the husband now does not even want to prosecute his Petition for divorce; meaning thereby that he does not even want to justify or prove the allegations made by him in the Petition for divorce.
