24. So, above decision is helpful 2nd respondent
with regard to levy contributory negligence on the part of
petitioner in traveling on the top roof of the bus. But to
meet the defence of 2nd respondent, counsel for petitioner
has placed his reliance on the decision reported in
2009(4) AIR KAR R.193 (New India Assurance Co.,
Bengaluru versus Jayashree alias Laxmi and Ors.)
wherein Division Bench of Hon'ble High Court of
Karnataka has held that;
