Chaman Lal vs State Of U.P. & Anr on 16 August, 2004

In another decision of the Hon'ble Apex Court in the case of Chaman Lal v. State of U.P. And another, (2004) 7 SCC 525, it has been observed that a detailed examination of evidence and elaborate documentation of merits of the case is not required, while dealing with an application under Section 439. However, when a serious offence has taken place, the Court shall give reasons without discussing the merits or de-merits of the case.
