5. Apart from conditions (a) to (c) in Section 437(3) of the
CrPC, there is a power to impose additional conditions “in the
interest of justice”. The scope of the concept of “interest of
justice” in Section 437(3) of the CrPC has been considered by
this Court in the case of Kunal Kumar Tiwari v. State of
Bihar2. In paragraph 9, this Court held thus:
