Management of American Express International Banking Corporation, reported in AIR 1986 SC 458, it has been held that, 'Secs. 25F and 25B (2) - Workman Continuous service Actual working days - Calculation of Sundays & other paid holidays can be taken into account.' And it is also further held that, 'In view of Sub-section (2) of Section 25B of the Act, the workman shall be deemed to be in continuous service if he has actually worked under the employer for particular period.'

In some cases, even unilateral provisions, that the service of an employee can be terminated at any time without assigning any reason are inserted in such cases, the Apex Court in West Bengal State Electricity Board v. Shri Desk Bandhu Gosh, 1985 (1) LLJ 373 struck down Regulation 34 of the West Best Electricity Board regulation which empowered the Board to terminate service of the employee by giving three months' notice or three months' salary in lieu of the notice being violative of Article 14 of the Constitution. The Apex Court has observed that, 'on the face of it, the regulation is totally arbitrary and confers on the Board a power which is capable of vicious discrimination. It is a naked hire and fire rule.'
