It has been argued
by the petitioner that such appointment is coram non-judice
as held by this Court in Request Case No. 48 of 2019 (M/s
Sudama Mal vs. The Union of India and Ors.). An application
under Article 227 of the Constitution would therefore be
maintainable to enable this Court to satisfy itself whether or
not the arbitral tribunal has acted within the bounds of its
authority.
