As held by the Hon'ble Supreme Court in
Priya Patel's case (supra), the conviction of the accused
appellant Razi @ Razia under section 376/109 IPC
cannot be sustained because she was not charged for
conspiracy or abatement to commit the offence of
rape and from the cross-examination, it cannot be
said that she has not been prejudiced in defending
herself.
