In view of the judgment titled Rangappa Vs. Mohan
AIR 2010 SC 1898 it is clear that a rebuttable presumption arises in
favour of the complainant that the cheque Ex. CW-1/A was issued by
the accused in discharge of legally enforceable debt. As stated, the
presumption is rebuttable and the onus to rebut the same lies upon the
shoulders of the accused.
