1 - 8 of 8 (0.36 seconds)Rajnesh vs Neha on 4 November, 2020
In Rajnesh (Supra), it was also held that issue of
interim maintenance is decided on the basis of pleading where
some amount of guess work on rough estimation takes place, so
as to make a prima facie assessment of the amount to the
awarded. It is often seen that both parties submit scanty material,
do not disclose the correct details and suppress vital information,
which makes it difficult for the Family Courts to make an
objective assessment for grant of interim maintenance. While
there is a tendency on part of the wife to exaggerate her needs,
there is a corresponding tendency by the husband to conceal his
true income. Hon'ble Supreme Court has directed to the parties
to file their income, assets and liabilities and held that there is no
straitjacket formula for fixing the quantum of maintenance to be
awarded.
