19. Learned counsel Mr. Malhotra, appearing for the insurer has heavily relied on the decision in case of Minu B. Mehta v. Balkrishna Ramchandra Nayan 1977 ACJ 118 (SC). His submission is that the liability of the owner of the car to compensate the victim in a car accident due to negligent driving of his servant is based on the law of Torts and it is on the basis of vicarious liability that the owner is made liable and it is necessary to prove that the servant was acting during the course of his employment and he was negligent.
