7. If the petitioner is desirous of being governed by the
proposed alternative scheme, they shall file affidavit within four
weeks from the date of receipt of a copy of this order, with the
2nd respondent herein. If such an affidavit is filed, petitioner
shall not be proceeded with in furtherance of the notification

dated 01.03.1988 and the communication impugned in this writ
petition. If the petitioner does not file any such affidavit, the
respondents are at liberty to proceed against the petitioner-
College in terms of the observations made in paragraph 4 of the
judgment stated supra wherein the judgment of the Supreme
Court in Sir Gangaram Trust Society and Another Vs Union of
India & Others passed in Civil Appeal No.7284/2005, is referred
to, in accordance with law after affording due opportunity to the
petitioner to putforth its case. In which event, all contentions of
both parties would be kept open.
