In The New Beerbhom Coal Co. v. Bularam Mahata, (1880) ILR 5 Cal 932 (PC) their Lordships of the Judicial Committee was of the view that where there is no express stipulation as to the price payable in a contract to sell land specific performance can be granted on the basis of the reasonable price of the land to be ascertained by the Court.
