39) Admittedly, Plaintiff's date of birth has been
accepted and recorded in service register on
20.05.1987, the date on which he became the
permanent employee of 4th Defendant. Under such
circumstance, there is no scope to alter the date of
birth after lapse of three years from the date of its
acceptance. Said principle of law has been laid
down in the above judgments. On considering
Section 5(2) of the Act and principle of law laid
down by the Hon'ble Supreme Court, it has been
clear that, there is no scope for State servant to
change his date of birth once same is accepted and
recorded in service register.
