15. Regarding liability: The learned counsel for
the insurance company has contended that the petitioner
himself was the rider of the motorcycle. Hence, he will
step into the shoes of the owner. Therefore, he is not
liable to claim compensation under Section 163A of the
Motor Vehicles Act. To buttress his argument, he placed
reliance on the decision of the Hon'ble Apex Court in the
case of Ramkhiladi (supra).

The issue involved in the present case
is squarely covered by the judgment of the Hon'ble Apex
Court in the case of Usha Devi (supra). In view of the
