In support of this submission reliance has been placed on a decision of the Supreme Court in the case of State of Bombay (now Maharashtra) v., Vishnu Ramchandra, (AIR 1961 S.C. 307), and my attention has been drawn to the following passage from paragraph 6 of the judgment--
