19. State of Punjab v. Jagjit Singh and others [(2017) 1 SCC 148] was, according to us, in a totally different context and the principle of 'equal pay for equal work' applied there, has no O.P(CAT) Nos.99/2019, 118/2019 & 24 of 2020 40 application on the facts of this case. Therein a Full Bench of the High Court held that temporary employees were not entitled to the minimum of regular pay scales, merely for reason of work carried out being similar to that of regular employees. The Hon'ble Supreme Court held that it is fallacious to determine artificial parameters to deny fruits of labour and an employee engaged for the same work cannot be paid less than another, who performs the same duties and responsibilities, especially by a welfare State. Such a contingency of discrimination of pay as between employees, does not arise herein at all.
