60) In view of the law laid down by the Hon‟ble Supreme Court
in "Godrej Sara Lee Ltd. Vs. The Excise and Taxation Officer-
cum-Assessing Authority and Others" (referred above) mere
availability of alternative remedy is not a bar to entertain the writ
petition. Moreover, in the case on hand, the petitioner sought to
set aside the proceedings issued under Section 73 of the Act as a
consequential relief.
