4. Under the above said circumstances, the
previous rule which was in existence is applicable and the
authorities would have applied their mind to the
amendment, the date of death of the deceased and the
application filed thereafter within one year from the date of
attaining the age of majority by the petitioner. It is worth
to mention here a decision of this Court which is passed in
W.P. No.67017/2009 dated 01.03.2012. Similar set of
facts arouse for consideration before this Court in the said
case between ANNAPPA N. MADAR V. HUBLI DHARWAD
MUNICIPAL CORPORATION, DHARWAD, this Court has had
an occasion to deal with date of death of the deceased and
as well as the amendment to the Rule. This Court has
observed at paragraph 2 in the following manner :
