In Harijan Megha Jesha v. State of Gujarat , and Sharad Birdhichand Sarda v. State of Maharashtra , it has been held that the circumstance which was not put to the accused while recording his plea, cannot be used against him. Therefore, the findings of the learned trial Judge to the effect that the house where the alleged crime was committed and the room from where the dead body of Ganga Ram alongwith pair of blood stained shoes were recovered belonged to the appellant is perverse and not based on any legal evidence.
