In Vishwanath Bapurao Sabale v. Shalinibai Nagappa Sabale & Ors. reported in (2009) INSC 601, the Hon'ble Apex Court has held that for claiming adverse possession, there should be a peaceful, open and continuous possession, being the ingredients of the principle of adverse possession as contained in the maxim nec vi, nec clam, nec precario, hence, possession of a property for a longer period itself would not be sufficient to prove the adverse possession for claiming title.
