Referring to the decision in D.B.Belliappa case (supra), this Court in Ajay Mohanty case (supra) has held that there was absolutely no allegation in the return filed by the opposite parties that the petitioner was considered unsuitable or that his service was found to be unsatisfactory. The opposite parties did not further produce any material to show that the persons junior to the petitioner have better service records than that of the petitioner. Since no material with regard to the records of service was produced, the Court is not in a position to accede to the contention that the petitioner stood as a class by himself. In absence of any cogent material available on record, this Court has no hesitation to hold that the impugned order passed in Annexure-15/A can sustain. Accordingly, the same is quashed.
