31. Likewise, in Sarup Singh's case (supra), the prosecutrix had gone
to answer the call of nature at a place meant for women folk, whereas her
husband went at a place meant for men in the village. After being free, the
prosecutrix started coming back towards her house. At that very moment, the
accused caught hold of her from neck and also gagged her mouth. Thereupon
she grappled with him and during scuffle, she sustained injuries on her right
cheek and right leg. When the accused further attempted to assault, then she
raised an alarm, which attracted her husband Ram Pal to the spot, but the
accused escaped from the place of occurrence. On the peculiar facts and in the
circumstances of those cases, it was held that only offence under section 354
IPC is made out.
