23. The question was very fully gone into in Manuel Louis Kunha v. Juana Coelho (1908) I.L.R. 31 Mad. 187, where it was held that the rule of equity that a legatee who undertakes to carry out the wishes of the testator will be treated as a trustee and compelled to carry out the instructions of the testator was made applicable to India by Section 5 of the Indian Trusts Act.
