2. On facts and in view of rebuttal evidence placed on record by accused at Ex.D1
and 2 the principle laid down in citations relied on by the complainant is not at all
applicable. Considering the complainant allegations, entire oral evidence coupled
with documentary evidence, in the considered opinion of this court, the
complainant has miserably failed to place the material to show that the notice/
Ex.P5 served on the accused as required under law.
