20.The learned counsel appearing for the petitioner drew the
attention of this court to a Judgment of the Hon'ble Supreme Court
in the case of Share Medical Care Vs. Union of India reported in
2007 (209) E.L.T 321 (S.C.) and referring to the said judgment,
the learned counsel for the petitioner submitted that “Even if the
applicant does not claim any benefit under a particular notification at
initial stage, he is not debarred, prohibited or estopped from claiming
such benefit at a later stage.
