It is not in dispute that the petitioner has earlier filed a writ petition in W.P.(MD)No.13369 of 2021, against the Police Officials, seeking writ of https://www.mhc.tn.gov.in/judis 5/11 mandamus to direct the Director General of Police to take appropriate action against the respondents 4 to 6 as per the guidelines issued by the Hon'ble Constitutional Bench of the Supreme Court of India, in Lalitha Kumari Vs. State of Uttar Pradesh, reported in (2014) 2 SCC 1 and on the basis of the representation submitted by the petitioner, dated 20.07.2021 in accordance with law within the time stipulated by this Court and when the matter was taken up on 04.08.2021, a learned Judge of this Court, considering the submissions of the learned Additional Public Prosecutor that the petitioner's wife was involved in job rocketing and one Brindha Rani gave a complaint before the District Crime Branch, Virudhunagar and enquiry was pending and only as a counter blast, the complaint was given and that neither the petitioner nor his wife has made has made a statement with regard to the articles that they have been stolen from the shop, has observed that since it is a matter for enquiry or investigation let enquiry result be intimated to this Court for further consideration. Subsequently, when the matter was taken up for final disposal on 22.02.2022, considering the submission made by the learned Government Advocate (Criminal Side) that based on the complaint lodged by the petitioner, dated 20.07.2021, the respondent Police conducted enquiry and the same was closed on 04.10.2021 and in view of the above, the Writ Petition was dismissed. https://www.mhc.tn.gov.in/judis
