In Ram Bachan versus Deputy Director of Consolidation Varanasi (supra), the petitioner filed an objection regarding the land in dispute that it was liable to be allotted to him as the same was situated near his house. On the other hand, the respondent claimed that the land in dispute was not a part of the original land of the petitioner therefore he had no right to get the same allotted in his favour. The Court observed that the petitioner had no legal right to claim allotment of land in dispute in his favour only because the said land was situated near his house.
