10. The submission of the learned counsel for the appellant was that the appeal
be accepted and the impugned judgment dated 7.10.2005 be set aside. It was also
submitted that the second complaint was maintainable. Reliance was placed on
the judgment of the Hon'ble Supreme Court reported as "New India Assurance
Co. Ltd. v. R. Srinivasan" 2000(1)CLT 414.
