In order to consider these rival contentions, we may

firstly notice the decision of the Supreme Court in the case of
State (NCT of Delhi) vs. Sanjay. The point for consideration in
the said judgment was, whether the provisions contained in
Sections 21 and 22 and other sections of the MMDR Act
operate as a bar against prosecution of a person who has been
charged with the allegation which constitutes offences
punishable under Sections 379 and 114 as well as other
provisions of the IPC. In other words, whether the provisions
of the Mines and Minerals Act explicitly or impliedly excludes
the provisions of the IPC when the act of the accused is an
offence both under the IPC and under the provisions of the
MMDR Act.
