In the
Court's opinion, the Supreme Court's decision in case of Sawarni
Kaur v. Inder Kaur (supra) is distinguishable, where the Court
was not dealing with the provisions akin to Sections 4 and Section
37 of the Bihar Consolidation Act. Dealing with the provisions
under U.P. Land Revenue Act, 1901, the Supreme Court has held
in the said case that mutation of name in revenue records does not
create or extinguish the title nor does it have any presumptive
value on title.
