As per observations of Hon'ble High court of
Delhi in Khubi Ram Sharma Vs. Yashpal & Ors., unless there is a layout
plan, which is sanctioned u/s 313 of DMC Act as sine qua non, it cannot be
that a private street would become a public street. The declaration Ex.
D1W1/C, which has been relied upon on behalf of defendants to prove that
East side of their plot was a 10 feet road, has been challenged on behalf of
the plaintiffs as false, forged, fabricated and unregistered and that same has
not been proved by the defendants as per rules of evidence.
