If the landlord pleads that the contractual tenancy has been terminated or remains silent about it and the tenant fails to raise the defense of non-maintainability of the petition on the ground of nontermination of the contractual tenancy, then according to the decision in Batoo Mal v. Rameshwar Nath, the tenant would be deemed to have waived the said plea.
