In view of the law laid down in Jaya Gokul Education Trust v. Commission and Secretary to Government, Higher Education Department, (2000) 7 SCC 231 and Thirumuruga Kirupananda Variyar Thavathiru Sundara Swamigal Medication Educational and Charitable Trust v. State of Tamil Nadu, (1996) 3 SCC 15, read with the provision in Section 10-A(4) of the respective Acts, the State cannot withhold the essentiality certificate on any policy consideration as the matter with respect to policy of establishment of new medical college now vests with the Central Government alone.
