In the said decision, the Tribunal, after an elaborate analysis of Rule 19(ii) of the Delhi Police (Promotion & Confirmation) Rules, 1980 and the relevant Standing Orders, has categorically held that OTP vacancies are required to be considered on a year-wise basis and cannot be clubbed across different years. It has further been held that failure to convene the Incentive Committee for a particular year, despite availability of vacancies, and subsequent clubbing of cases of multiple years results in enlargement of the zone of consideration, thereby causing serious prejudice to eligible candidates.
