14. In view of the above submissions, the
contention of the Insurance Company in MFA
No.200835/2021 so far as it relates to contributory
negligence cannot be accepted. The judgment of the Apex
Court in the case Khenyei vs. New India Assurance Co.
Ltd1 lays down the principles of composite negligence.
Therefore, what remains to be considered is only about the
quantum of compensation based on the income and
disability of the petitioner.
