In view of our decision in State v. Ram Autar Chaudhry, 1955 All LJ 330 : (AIR 1955 All 138) (A) this confession cannot be taken in evidence as a Magistrate can record a confession under Section 164, Criminal Procedure Code, during the investigation of a crime by the police and not subsequent to the closing of the investigation and the submission of the charge-sheet. We may, however, briefly mention, in view of the accused's admitting during his statements in court the voluntary nature of this confession and repeating practically what is mentioned therein, that the accused stated that he had taken the deceased Nainsukh to the grove at the asking of one Narain Singh and that at the grove after certain altercation Nainsukh was murdered. In the confession the actual description of the murder is given thus:
