In course of hearing a decision of the Full Bench of Allahabad High Court was brought to our notice in the case of Ram Charan v. State of U.P. . In that decision a finding which was arrived at under the provisions of Consolidation Act was under consideration and, therefore, the Full Bench held that in view of Section 38B of Ceiling Act, the said finding will have no binding effect in the ceiling proceedings. The said decision has no application to the facts of the present case.
