6. Above said five witnesses were the only competent
witnesses who could have established identity of the accused.
PW1 and PW2 are only the formal witnesses. The public witnesses
did not support the prosecution case, and hence, further evidence
State Vs. Nawab etc. 5 of 6
was closed because no fruitful purpose was to be served by
examining the remaining witnesses. As there is no incriminating
material against any of the accused, their statements u/s 313 Cr.PC
were also dispensed with.
