(29) It stands established that the injured/ petitioner had suffered
Grievous Injuries in the accident in question but the aspect of his
having suffered any Disability has not been proved. I hereby hold that
the fixed compensation of Rs.50,000/ (Rupees Fifty Thousand only)
is to be awarded to the petitioner/ injured Arun Kumar.
(30) I may note that interest @ 9% per annum was awarded by
the Hon'ble Apex Court in the case of Municipal Corporation of
Delhi Vs. Association of Victims of Uphaar Tragedy reported in 2012
ACJ 48 (SC). In the interest of justice, it is held that claimants shall be
entitled to interest @ 6% per annum from the date of filing of DAR i.e.
from 23.04.2022 till realization.
